Conditions of entry

  1. Information regarding prizes and how to enter forms part of these conditions.  By entering, entrants accept these conditions.
  2. Entry is open only to Australian residents aged 18 or over who are able to take the prize on the dates specified by the Promoter.  Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, of any participating outlets or of the agencies or companies associated with this competition are ineligible to enter.
  3. The competition begins at 9.00am (AEDST) on 01/12/08 and closes at 5.00pm (AEDST) on 22/03/09 (Competition Period).
  4. To enter, consumers must, during the Competition Period, purchase a specially marked 24 pack or 30 pack of either VB or VB Gold beer featuring a VB Top Ticket logo (Eligible Purchase) from any participating liquor outlet (Outlet) for off-premise consumption and submit their entry by one of the following methods:
  5. send an SMS (maximum cost 55 cents (inc GST)) from their mobile phone to 1970 0000 stating in one message, and in the following order, the word corresponding to the trip they would like to win (as described in paragraph 8), the unique code (found either on the inside of the specially marked pack or on the reverse side of the specially marked sticker on the pack), and their first name, last name and post code (e.g. LONDON [SPACE] 94444 [SPACE] John [SPACE] Smith [SPACE] 3001).  (Errors and omissions excepted in the Promoter’s discretion. Computer generated SMS entries will not be accepted.); OR
  6. log on to www.vbtopticket.com and fully complete the online entry form, including their first name, last name, post code, email address, the unique code (found either on the inside of the specially marked pack or on the reverse side of the specially marked sticker on the pack) and the word corresponding to the trip they would like to win (as described in paragraph 8) and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with accessing the Internet.
  7. All entries must be received during the Competition Period.  Consumers may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and a separate unique code.  Consumers must retain their receipt(s) to verify each entry.  Failure to provide this/these to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid).  The Promoter accepts no responsibility for (and may, in its absolute discretion, invalidate any) late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.  The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
  8. Entrants who enter using multiple mobile phone numbers/email addresses and/or aliases will be disqualified.  In the event of a dispute regarding a prize awarded to an SMS entrant, the prize will be awarded to the owner of the relevant mobile phone. 
  9. SMS entry is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number.  Consumers should check with their network service provider to see if their mobile phone is compatible.
  10. There are 5 prizes to be won.  Each prize is a trip is for 2 adults to one of various destinations (Trip), as follows:
    Cricket Trip: Cricket in England in July 2009 (exact dates to be specified by the Promoter).  Consumers who would like to win this Trip must enter the word ‘LONDON’ in their entry (as described in paragraph 4) to show they have nominated this Trip as their preferred prize. The Cricket Trip includes 2 return economy airfares from the winner’s nearest Australian capital city to London, 7 nights’ accommodation for 2 adults in a minimum 4 star hotel (of the Promoter’s choice) in London (including daily breakfast for 2 people), return transfers for 2 people between Heathrow airport and the hotel, reserved seats for 2 people for 4 days at the npower Ashes Series 2009 at Lords (Cricket Australia Ticket Code: CA0029), a London Travelcard to the value of GBP20 for travel in getting to and from the hotel and Lords, a tailored suit (of the winner’s choice) for the winner from 40 Saville Row valued at up to AUD$2,500, a dinner for 2 people at a curry house on Brick Lane (as determined by the Promoter) to the value of AUD$250, an art gallery visit for 2 people (at a gallery in London as determined by the Promoter) and AUD$5,000 spending money for the winner.  The Cricket Trip is valued at up to $26,700 (inc GST).  Any value incurred over AUD$250 at the dinner will be the prize winner’s responsibility.  Any unused portion of the AUD$250 dinner will be forfeited by the prize winner and cash or credit will not be supplied in lieu.

    Surfing Trip: Surfing in Hawaii in 2009 (exact dates to be specified by the Promoter). Consumers who would like to win this Trip must enter the word ‘HAWAII’ in their entry (as described in paragraph 4) to show they have nominated this Trip as their preferred prize.  The Surfing Trip includes 2 return economy airfares from the winner’s nearest Australian capital city to Hawaii, 7 nights’ accommodation for 2 adults in a minimum 4 star hotel (of the Promoter’s choice) in Hawaii (including daily breakfast for 2 people), return private car transfers for 2 people between Hawaii airport and the hotel, surfing activities (as determined by the Promoter) including a surfing lesson with Mick Fanning, a Hawaiian buffet dinner at Palm Terrace at Turtle Bay Resort including Kalua Pig with Mick Fanning, a game of volleyball with Mick Fanning, 4 days convertible car hire to attend the Pipeline Masters on the North Shore (including entry if required) and AUD$5,000 spending money for the winner.  The Surfing Trip is valued at up to $23,500 (in GST).  The winner and their companion must be fit and healthy and experienced in swimming in the ocean and must, at all times, comply with all requirements and directions of Mick Fanning during the surfing lesson.

    Racing Trip: Racing in Monaco in 2009 (exact dates to be specified by the Promoter).  Consumers who would like to win a trip to this destination must enter the word ‘MONACO’ in their entry (as described in paragraph 4) to show they have nominated this Trip as their preferred prize. The Racing Trip includes 2 return economy airfares from the winner’s nearest Australian capital city to Nice, France, 2 return transfers from Nice airport to Monaco, 5 nights’ accommodation for 2 adults in a minimum 4 star hotel (of the Promoter’s choice) in Monaco (including daily breakfast for 2 people), return private car transfers for 2 people to the hotel, racing activities (as determined by the Promoter) including 2 day race tickets for 2 people in Grandstand L (pits) at the Monaco Grand Prix with a tour of the pits with Mark Webber, dinner at Le Padouk Restaurant for 2 people to the value of 400 EUR, 1 day all inclusive Elite BMW Z4 Roadster (or similar as determined by the Promoter) car hire and AUD$5,000 spending money for the winner.  The Racing Trip is valued at up to $29,500 (inc GST).  Any value incurred over 400 EUR at the dinner will be the prize winner’s responsibility.  Any unused portion of the 400 EUR dinner will be forfeited by the prize winner and cash or credit will not be supplied in lieu.

    Music Trip: Music festival or music concert in Japan in 2009 (exact dates to be specified by the Promoter).  Consumers who would like to win a trip to this destination must enter the word ‘JAPAN’ in their entry (as described in paragraph 4) to show they have nominated this Trip as their preferred prize.  The Music Trip includes 2 return economy airfares from the winner’s nearest Australian capital city to Japan, 7 nights’ accommodation for 2 adults in a minimum 4 star hotel (of the Promoter’s choice) in Japan (including daily breakfast for 2 people), return transfers for 2 people between Japan airport and hotel, 2 day entry to a music festival or music concert (as determined by the Promoter), an opportunity to hang out with The Living End during the music festival or music concert, attend dinner/drinks with The Living End after the show at a local bar (as determined by the Promoter) to the value of 75,000 JPY, go with The Living End to Tokyo Dome including 30,000 JPY spending money, 1 day car hire of a Mazda RX-8 (or similar, as determined by the Promoter), a Gretch White Falcon guitar (for the winner only) signed by Chris Cheney valued at $6,500 and AUD$5,000 spending money for the winner.  The Music Trip is valued at up to $30,000 (inc GST).

    Poker Trip: Poker in Las Vegas in 2009 (exact dates to be specified by the Promoter).  Consumers who would like to win a trip to this destination must enter the word ‘VEGAS’ in their entry (as described in paragraph 4) to show they have nominated this Trip as their preferred prize. The Poker Trip includes 2 return economy airfares from the winner’s nearest Australian capital city to Las Vegas, 5 nights’ accommodation for 2 adults at a minimum 4 star hotel (of the Promoter’s choice) in Las Vegas (including daily breakfast for 2 people), return private car transfers for 2 people between Las Vegas airport and the hotel, poker activities (as determined by the Promoter) including watching a professional Las Vegas poker tournament live, 2 category B tickets to a World Title Fight accompanied by Kostya Tszyu at MGM Grand Garden Arena, 2 Tapis Rouge tickets to The Beatles LOVE by Cirque du Soleil show including one week’s free VIP access to the Revolution lounge at The Mirage, Las Vegas including exclusive food and drink selection, specially designed LOVE gift bag and preferred seating for the show, 5 hour limousine hire to cruise the Vegas strip, bars and clubs and AUD$5,000 spending money for the winner.  The Poker Trip is valued at up to $25,000 (inc GST).
  1. The total prize pool is valued at up to $134,700 (inc GST).
  2. The Promoter does not guarantee that any person will win a Trip to their chosen destination (as nominated in their entry).
  3. A draw will be conducted at 3.00pm (AEDST) on 25/03/09 at 2 - 6 Glenferrie Road, Malvern, Victoria 3144.  The first valid entry randomly drawn from all of the entries received for each Trip will be deemed the winner of that prize.  If no entries are received for a particular destination (e.g. the Racing Trip), then the Promoter will (at 3.15pm (AEDST) on the same date as the original draw) randomly draw a winner from all of the valid entries received, regardless of the destination entrants nominate, and which have not already won a prize, in order to determine a winner of that prize.
  4. Flights and accommodation are subject to booking and availability and confirmation by the travel supplier at the time of booking.  All bookings are subject to the travel supplier’s booking conditions.  Each Trip must be taken on the dates as specified in paragraph 8.  All other costs associated with any prize that are not specified, including but not limited to any additional meals, transfer costs, taxes, insurance, additional spending money and other ancillary costs are the responsibility of the winners and their companions as incurred.  The winners and their travelling companions are responsible for ensuring that they have all necessary documents to travel to the relevant destination (including a current passport and any visas that may be required).  The winner and their travelling companion are also responsible for ensuring they take any necessary inoculations prior to taking the Trip.  Where car hire is included in the prize, the prize winner or their companion must be aged 25 years or over and must have a current Australian drivers licence.  The car hire is also subject to any terms and conditions specified by the car hire provider.  If these conditions are not met, the car hire component of the prize (where relevant) will be forfeited by the prize winner.  Where a prize involves meeting and/or attending an event with a celebrity, the Promoter will not be liable for the failure of the winner (and their companion) to meet that person or failure of that person to attend the event, for whatever reason.
  5. The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
  6. If an entry in the draw is deemed not to comply with these conditions of entry (including because an entrant is unable to take the prize on the dates specified by the Promoter), the Promoter reserves the right to discard that entry and a new winner of that prize will be determined by drawing a further valid entry, in accordance with paragraph 11.
  7. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  8. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.
  9. The winners will be notified by phone and in writing (immediately after the draw) and will have their name and state/territory of residence published on www.vbtopticket.com.au and also The Australian newspaper on 27/03/09.  By entering this competition, each entrant requests that his or her full address not be published.
  10. Each winner must claim their prize by 01/04/09.  In the event of a prize not being accepted or claimed by 01/04/09 or if, after making all reasonable attempts, the Promoter cannot contact a drawn winner by 5.00pm (AEST) on 01/04/09, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct such further draws at the same location as the original draw on 02/04/09 at 10.00am (AEST) as are necessary to distribute the prize(s), subject to any written directions given by any relevant gaming authority, where required.  The winner(s) in this draw, if any, will be notified by telephone and in writing.  This process will continue, allowing 24 hours for contact, until 10/04/09.  Once the winner(s), if any, are confirmed by the Promoter, their details will be published in The Australian newspaper on 11/04/09.
  11. The Promoter may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
  12. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.  The Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize to a winner and their companion if the winner (or their companion), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this promotion, is contrary to law or is otherwise inappropriate.
  13. Entrants acknowledge that there are inherent risks in some aspects of the Trips described in paragraph 8 and that taking a Trip prize may involve participating in dangerous activities.  By entering this competition and accepting any Trip prize, entrants accept that risk.
  14. The winners and their companions must, if requested by the Promoter, sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the Trip prize prior to undertaking the activities included in the Trip prize.  If a winner or their nominated companion does not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim will be deemed invalid.
  15. Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value.  In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize.  Where a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities, where required.
  16. If for any reason any aspect of this competition is not capable of running as planned, including, but not limited to, by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, where required.
  17. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  18. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines available at http://www.alcoholguidelines.gov.au.  Entry and continued participation in this promotion is subject to each Outlet’s liquor serving policy.
  19. All entries will be the property of the Promoter.  The information entrants provide will be used by the Promoter for the purpose of conducting this competition.  The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants.  By entering this promotion, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging.  By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
